MEMORANDUM OPINION

TILLEY, District Judge.

This case comes before the Court on Defendant’s Motion for Summary Judgment [Doc. # 61]. For the reason stated below, the Defendant’s motion is DENIED.

I. Factual Background

Plaintiff Static Control Components, Inc. is a North Carolina corporation which distributes aftermarket 1 components and toner for remanufactured laser toner cartridges.
