Mr. Judge Slatton

of the Commission of Appeals delivered the opinion for the Court.

This suit is for damages occasioned by trespasses alleged to have been committed by the servants, agents and employees of Winfield Scott. A judgment was rendered upon a special issue verdict against Scott. The Court of Civil Appeals reversed the judgment of the trial court and rendered judgment in favor of Scott. 165 S. W. (2d) 467.
