The defendant was indicted for unlawfully discharging and depositing sawdust, planer shavings, and other lumber waste,'made by a saw mill, into the waters of the Santiam river, in violation of section 8 of an act entitled, “An act to protect salmon and other food fishes in the state of Oregon and upon all waters upon which this state has concurrent jurisdiction, and to repeal sections 3489, 3490, 3491, 3492, 3493, 3494, 3495, 3496, 3497, and 3498 of Hill’s Annotated Laws of Oregon,” approved February 6, 1891.
