— This is an action for malicious prosecution. The respondent was arrested on a warrant-issued by a magistrate charging him with the crime of bringing stolen property into this state from a foreign country, and confined in jail for about one week’s time. At the time fixed for the preliminary hearing he was discharged at the request of the prosecution without examination or any evidence being brought against him.
