Presently before the Court are Plaintiffs Complaint (Doc. 1), Defendant’s Motion to Dismiss (Doc. 6), Plaintiffs Response to the Motion to Dismiss (Doc. 9), Defendant’s Reply to the Response (Doc. 12), Plaintiffs Amended Complaint (Doc. 14), and Defendant’s Amended Motion to Dismiss (Doc. 15). Upon consideration of the parties’ motions and for the reasons set forth below, Defendant’s Motion to Dismiss is DENIED.
