Walters Bender Strohbehn & Vaughan, P.C. (“the Firm”) appeals the judgment of the circuit court that dismissed its Petition based on Elizabeth Mason’s (“Mason”) motion to dismiss. We reverse and remand.

Factual Background

On March 3, 2008, the Firm filed its Petition against Mason in Jackson County Circuit Court.
