The defendant is charged in a 13-count indictment with various offenses arising out of six allegedly extortionate incidents occurring over a two-month period at three different Chinese restaurants. The defendant moves to sever the counts related to each of the separate incidents. The People resist severance asserting that the counts relating to each of the incidents are properly joined with those relating to other incidents under the provisions of CPL 200.20 (subd 2, par [b]).
