Appeal from an order of the Appellate Division of the Supreme Court in the first judicial department, entered December 20, 1912, which affirmed a judgment rendered at a Trial Term, upon a verdict convicting the defendant of the crime of grand larceny in the first degree. The facts, so far as material, are stated in the opinion. The court erred in receiving evidence by which it was intended to prove that another and similar crime had been attempted by the defendant.

The defendant appeals from a judgment of the Appellate Division in the first department affirming a judgment entered upon a verdict at Trial Term, convicting him of the crime of grand larceny in the first degree. The case is one of unusual interest, both in respect of the novel scheme or method by means of which the crime is said to have been perpetrated, and the number, variety and importance of the questions which we are asked to decide.
