OPINION OF THE COURT

Moule, J.

Defendant was convicted on three counts of second degree murder arising from the shooting deaths of three black males over a 26-hour period in September, 1980 on *508the east side of Buffalo. Defendant raises several contentions on appeal in support of his claim that his convictions must be reversed. An analysis of these contentions requires a recitation of the facts surrounding these homicides and the extensive pretrial proceedings which were conducted.
