Plank-Greer v. Tannerite Sports, LLC
District Court, N.D. Ohio
1Opinion of the Court
ORDER
JAMES G. CARR, Senior District Judge.
This is a personal injury case in which plaintiff Jennifer Plank-Greer alleges defendant James W. Yaney failed to use reasonable care when he detonated a refrigerator filled with explosives that nearly severed plaintiffs hand.
Defendant moves for summary judgment (Doc. 143) on the grounds that, as a licensor, he owed plaintiff only the duty to refrain from wantonly or willfully causing *888injury, and, even if he was a host, he did not breach his duty to exercise ordinary care. For the following reasons, I deny defendant’s motion for summary judgment.
