This is a declaratory judgment action brought by the appellant, United States Fidelity & Guaranty Company to determine rights and liabilities under a comprehensive automobile liability insurance policy issued by the appellee, Aetna Casualty & Surety Company. U.S.F.&G. originally filed this motion for declaratory judgment in the Circuit Court of Little River, Arkansas, in connection with an action for wrongful death, personal injury and property damage filed in that court against two U.S.F.&G. insureds.
