This matter is before me on the plaintiffs Motion to Remand, filed October 9, 2001. Defendants oppose remand, and the issue is fully briefed. The Motion to Remand is DENIED.
The case originated in the District Court of Larimer County, Colorado, on August 16, 2001. Defendants filed a Notice of Removal on September 11, 2001. Subsequently, all parties consented to the exercise of jurisdiction by a United States Magistrate Judge, and District Judge Edward W.
