SWINFORD, District Judge.

This is a proceeding brought pursuant to Section 338 of the Nationality Act of 1940, 54 Stat. 1158, 8 U.S.GA. § 738, for the purpose of denaturalizing the defendant, Frederick Nicholas Dittrich.

The defendant, a native of Germany and formerly a citizen of that country, entered the United States on July 2, 1928. On February 8, 1935, he filed his petition for naturalization in the United States District Court. In his petition, which was verified, he stated: “I am not a disbeliever in or opposed to organized government or a member of or affiliated with any organization or…
