MEMORANDUM

GILES, District Judge.

Plaintiff, Daniel King, an inmate at the State Correctional Institute at Graterford (“Graterford”) brought this action for compensatory damages and declaratory relief pursuant to 42 U.S.C. § 1983 (Supp. IV 1980), and 28 U.S.C. § 2201 (Supp. IV 1980) claiming that the defendants, correction officers and the superintendent at Graterford, subjected plaintiff to cruel and unusual punishment and deprived him of his rights to equal protection and due process of the law in violation of the Eighth and Fourteenth Amendments to the Constitution. 1 The plaintiff’s…
