This suit was brought by appellee against appellant to recover damages for false imprisonment and for assault made upon him by appellant. The petition contains the following allegations:

“Plaintiff says that on said 18th day of January, 1910, that he (plaintiff), together with his wife and family, consisting of six children, and his wife’s mother, was occupying under a contract of lease with defendant the certain brick building hereinbefore described, and conducting the business herein-before stated; that plaintiff had, by reason of misfortune and business reverses which were…
