The plaintiff, J. N. Moore, sues the defendants, the Chattanooga Electric Street Railway Company, a corporation owning and operating a street railway upon the streets of Chattanooga, and the East Tennessee Telephone Company, a corporation owning and operating telephone lines upon the streets of that city, for injuries sustained by him while acting as conductor, in *715the employ of the Chattanooga Electric Railway Company, by coming in contact with a pole erected by the East Tennessee Telephone Company in the street hear to, bnt not upon, the right of way of the street railway company.
