The plaintiff served as a yeoman in the United States Navy prior to December 21,1972. He was tried by a special court-martial on December 21, 1972, and January 18 and 25, 1978, after being charged pursuant to 10 U.S.C. § 886 (1970) with four specifications of unauthorized absence from his unit. He was found guilty of two of the specifications and sentenced to confinement at hard labor for 30 days and to forfeiture of $80.00 pay per month for one month.
