In the trial court defendant in error Hawthorne had judgment against plaintiff in error International-Great Northern Railroad Company for damages for personal injuries sustained by him as the result of a head-on collision between a locomotive in which he was riding and another locomotive pulling a regular north-bound passenger train of the railroad company. Hawthorne was the fireman on the engine in which he was riding and received his injuries when he leaped therefrom just prior to the collision. The Court of…
