In the trial court defendant in error, Mrs. Eveline Gillette, for herself and as the next friend of her minor children, Ralph E. Jr., Kitty Virginia, and Thomas Bryan Gillette, recovered judgment apportioned by the jury and aggregating $45,000.00 against plaintiff in error for damages sustained by her and her children on account of the death of Ralph E.
