Defendant appeals from a judgment rendered against him in an action for damages sustained by plaintiff by reason of his having been struck by defendant’s automobile.
As the facts will be more fully stated later, we notice the pleadings very briefly. The petition alleged that plaintiff was operating some equipment on the highway; that he stopped, descended on the left side and walked toward the rear, and that defendant negligently ran into him.
