This cause is in this court on appeal from the Court of Common Pleas of Franklin county.

On July 26,1937, Opal Baxter, an unmarried f emale, died a complaint charging that Harold Wright was the father of her unborn child. In due time the cause came on for trial and was heard upon the evidence presented and the charge of the- court. Thereupon the jury returned a verdict of guilty. A motion for new trial was filed and also a motion for judgment notwithstanding the verdict.
