This is an appeal, by a surety upon an undertaking, from an order adjudging him in contempt of court and fining him $2,120, and sentencing him to sixty days’ imprisonment and committing him to prison until the fine is paid.

In the action of Dollard v. Koronslcy, judgment by default was entered against the defendant. The defendant then moved for an order staying proceedings by the plaintiff under said judgment pending the determination of a motion to vacate the judgment on the ground that the defendant was not served with process.
