This action was commenced in the district court of Wright County in August, 1935, and was upon a promissory note executed by the defendant, Enno Suntken, dated September 3, 1931, and due March 1, 1933. The defendant in his answer admitted the execution of the note in suit and admitted that but for the amount due defendant on his counterclaim there would be due to plaintiff on said promissory note the amount thereof with accrued interest.
