Appellee was struck and injured by one of appellant’s locomotives attached to a passenger train at a point in Terrell, Tex., where the appellant’s railroad crosses Moore avenue. Suit was instituted in the court below, the complaint alleging such injuries to be the result of the negligence of appellant in: (1) Failing to sound the whistle and ring the bell for the crossing ; (2) moving the train at a high and dangerous rate of speed; (3) the presence of 'buildings and platforms upon appellant’s right of way and the permitting of cars to-stand upon its side track, thereby obstructing appellee’s…
