In October 2013, a Kentucky jury awarded $3,736,278 to the estates of Kait-lyn Griffin and her child, Ms. Griffin’s parents, her child’s father, and her cousin, Joshua Thacker. Evanston Insurance Co. provided excess liability insurance to the defendant in that action, Housing Authority of Somerset (HAS). Following trial, Ev-anston filed a declaratory judgment action in federal court to determine coverage limits under its policy with HAS.
