Appeal by the defendant, George W. Davison, from a judgment of the Supreme Court in favor of the plaintiff, entered. in the office of the clerk of the county of Kings on the 5th day of November, 1910, upon the verdict of a jury for $1,580, and also from two orders entered in said clerk’s office on the 18th and 21st days of November, 1910, respectively, denying the defendant’s motions for a new trial made upon the minutes.

Carr, J.:
The defendant appeals from a judgment against him in favor of the plaintiff in an action tried before a jury at Trial. Term of the Supreme Court in Kings county. The complaint alleged a negligent operation by the defendant of an automobile on a public highway of the city of New York, in the borough of Manhattan, whereby the plaintiff was run down while crossing the street and injured severely. The answer put in issue the allegations of the complaint. The plaintiff proved the accident, and produced testimony to show that the automobile in question had displayed upon it a license…
