Cullen, J.:
This action is to recover damages for personal injuries alleged to have been caused by the negligence of the defendant. The defendant maintains a trolley railroad line on Third avenue in the city of Kew York. .The occurrence which is the subject of the action happened about two o’clock on the night of June 4, 1893. The plaintiff was standing at or near the corner of Third avenue and the Boulevard, when one of - the span wires that support the trolley wires of defendant’s railroad broke.
