Before the Court are cross motions for summary judgment filed by Sentinel Trust Company (“Sentinel”) as unsecured claimant and David Namer (“Mr. Namer”) as “party in interest objector” arising out of the proof of unsecured claim filed by Sentinel in the bankruptcy case of AVN Corpo ration (“AVN”). Samuel K. Crocker, Chapter 11 Trustee for AVN, has filed a response in opposition to the motion filed by Mr. Namer, but has not responded to the motion filed by Sentinel.
