In this diversity case plaintiff 1 appeals from the dismissal of his libel action under Rule 37, Fed.R.Civ.P., for refusing to answer certain questions posed by CBS during plaintiff’s oral deposition. Wehling asserted his Fifth Amendment privilege against compelled self-incrimination in response to the district court’s order to comply with defendant’s discovery request.
