This appeal is from an order which granted the plaintiff’s motion for a new trial, in an action brought by the plaintiff to recover $10,000 from the defendant. It appears that, in September, 1908, the plaintiff advanced to the defendant $10,000 for the purpose of purchasing stock in the Cache Creek Mining Company, a corporation. Later, in November of the same year, the plaintiff advanced $5,000 additional for the same purpose.
