MEMORANDUM and ORDER

NEALON, District Judge.

Presently before the court is a motion to dismiss pursuant to Federal Rule of Civil Procedure 12 (b)(6) filed on behalf of the defendants on September 5, 2000. (Doc. 12). The defendants filed a brief in support of the motion, along with exhibits, on September 19, 2000. (Docs. 14 & 15 respectively). • The plaintiff thereafter submitted a brief in opposition to the motion on October 12, 2000 (Doc. 16), to which the defendants replied on October 27, 2000. (Doc. 18).
