OPINION AND ORDER

BLACK, District Judge.

THIS MATTER comes before the Court for consideration of a motion to dismiss filed by defendant Santa Fe County. (Doc. 23). The Court held a hearing and has reviewed the submissions of the parties and the relevant law. For the reasons set forth below, the motion will be denied. In addition, however, the Court raises sua sponte the issue of exhaustion of administrative remedies under the Prison Litigation Reform Act (“PLRA”), 42 U.S.C. § 1997e.
