On March 1, 1915, the Empire Milling Company entered into a contract with the Kansas Gas and Electric Company by which the latter agreed to furnish it electric current for the operation of its plant for five years at a specified rate applied to the monthly reading of the meter, payment to be made monthly. The Empire Milling Company in May, 1918, assigned its rights under the contract, with the consent of the other party, to the Consoli*48dated Flour Mills Company.
