This action was begun in the district court of Seminole county by defendant in error, hereinafter styled the plaintiff, against plaintiff in error, hereinafter styled the defendant, to recover damages for the loss of his right eye, which, he alleged, was occasioned by a splinter from a steel bit flying off and striking him in such eye, while he was endeavoring to fasten such bit in the socket of the drill.
