This matter comes before the court upon the motion of defendants City of Minneapolis (City) and George Caldwell (Caldwell) for summary judgment pursuant to Fed.R.Civ.P. 56.

I. FACTUAL AND PROCEDURAL BACKGROUND

The factual allegations underlying this action arise from plaintiff M. Michele Cook’s (Cook) dealings with the Minneapolis Department of Civil Rights during the fall of 1980.
