This is an appeal from an order admitting to probate the will of John L. M. Robbins, deceased, over the objections of appellants, who contested the probate of the will upon the grounds (1) that it was executed under the undue influence of the proponent, respondent herein, and (2) that the decedent was mentally incompetent to execute the will. At the close of contestants’ case the court granted a “nonsuit” as to the undue influence ground of contest and submitted to the jury only the issue of testamentary capacity.
