1Opinion of the CourtShea, J.
The plaintiff brought this action to recover damages for injuries alleged to have been sustained as a result of the negligent operation of a motor vehicle by the defendant. The court rendered judgment for the plaintiff, and the defendant has appealed, claiming that the court erred in certain rulings on evidence; in finding that the defendant was negligent; and in failing to find that the plaintiff was chargeable with contributory negligence. The defendant also claims that the damages awarded were excessive.
