Before this Court is the appeal of April Davis (Davis) to the decision of the Court of Common Pleas of Philadelphia County (trial court) denying her petition to open a judgment of non pros.

Davis filed suit against the City of Philadelphia (City) alleging that she sustained serious injuries when she fell due to a defective City street. The case was scheduled for an arbitration hearing on April 1, 1996.
