MEMORANDUM OPINION AND ORDER
ROBERT C. CHAMBERS, District Judge.
Pending before the Court is Plaintiff’s Motion for Relief from Judgment (doc. 25) and Motion to Amend Complaint (doc. 33). Based on the parties’ briefs, and for the reasons discussed below, the Court GRANTS in part Plaintiffs Motion to Amend Complaint, to the extent that amendment is not futile. The Court also GRANTS in part Plaintiffs Motion for Relief from Judgment, to the extent that the Court has revised its analysis pertaining to field and conflict preemption.
