Pending are the motions for summary judgment of defendant GreenPoint Mort gage Funding, Inc. (“GreenPoint”) and defendant Countrywide Home Loans Servicing, LP (“Countrywide”), filed March 15, 2010, and March 29, 2010, respectively. Also pending is GreenPoint’s motion to dismiss Count V of the Third Amended Complaint, filed April 29, 2010. 1
