Under review is a judgment for the plaintiff in an action for malicious prosecution.

Designating the parties as they stood in the trial court, plaintiff in 1924 established himself in business as a retail grocer. His shop was on Hull street in South Richmond, where he catered to a modest clientele. Purchases were at first from the Staples Grocery Company but their prices were not satisfactory. Thereupon he shifted his patronage to the defendants, who were near-by wholesale grocerymen and who did a cash and carry business.
