This action was commenced by defendant in error, hereinafter referred to as plaintiff, against plaintiff in error, hereinafter referred to as defendant, by plaintiff filing his petition in the district court of Garfield county, Okla., on the 13th day of July, 1932, wherein it is alleged, stated briefly, that plaintiff was in the employ of defendant as a freight train conductor, and was employed as such by defendant on September 18, 1931, and had been so employed since 1919, and was 54 years of age and a strong, able-bodied man in good health; that on said date he received injuries from having…
