George Lias sued State Farm Mutual Automobile Insurance Company (State Farm) for breach of contract, breach of the duty of good faith and fair dealing, and violations of Texas Insurance Code article 21.55. 2 He alleged that State Farm re fused to pay benefits due within a reasonable time when it knew there was no reasonable basis for refusal to pay, and, for an unreasonable amount of time, State Farm offered an amount less than it knew the claim was worth.
