PICARD, District Judge.

Defendant was tried and convicted by this court on May 7, 1954 for refusal and failure to report for civilian work at the Kalamazoo State Hospital after being denied exemption from military service as' a duly ordained minister and classified as a conscientious objector. Subsequently his conviction was set aside, July 27, 1954 but further steps were held in abeyance since the parties indicated that all facts could be stipulated and the case fe-sú.bmitted on briefs.
