WINTER, District Judge.

Defendant was indicted for a violation of 50 U.S.C.A.App., § 462, for having knowingly failed and neglected, on or about August 9, 1961, to report for assignment, in lieu of induction, to civilian work contributing to the maintenance of the national health, safety or interest, .and thereby having knowingly failed .and neglected to perform a duty required of him by the Universal Military Training and Service Act, as amended, 50 U.S.C.A.App. §§ 451, et seq. Defendant requested a waiver of jury trial, which was consented to by the Government and approved by the Court. When…
