This action is for divorce. Defendant moved to set aside the service of the summons and to dismiss the action. In the notice of motion he stated that his appearance was special. The grounds of the motion were that the court did not have jurisdiction to grant a divorce because the plaintiff had not resided in the state at least one year nest preceding the filing of the complaint as required by 2 Mason Minn.
