MEMORANDUM OF DECISION
TORRES, District Judge.
The history of this litigation is described in United States v. Davis, 20 F.Supp.2d 326 (D.R.I.1998), and United States v. Davis, 11 F.Supp.2d 183, 186-87 (D.R.I.1998). For present purposes it is sufficient to state that the United States commenced this action against United Technologies Corp. (“UTC”) and eight other parties, pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), 42 U.S.C. §§ 9601-75, in order to recover response costs associated with remediating a hazardous waste site.
