The case was referred to Charles Corbet, Esq., as master, who reported in favor of dismissing the bill. Exceptions to the master’s report were sustained in an opinion by Clark, P. J., and a decree entered against the executor of John Keck for the amount claimed by the plaintiffs.

It was proved by indisputable testimony, and not at all denied, that the actual selling price of the land by the owner was $12,000, and that John Keck deceased obtained from W. 11. Brown & Co. who were the selling agents of the owners, an option to buy the land for $15,000. It is also an undisputed fact that tire price named in the deed was $24,240, and that the deed was made directly by the owner, Henry S. Mitchell, and his wife, to the ultimate purchasers.
