The plaintiff in error, H. M. Adams, hereinafter called plaintiff, commenced this action in the district court of Logan county on the 15th of December, 1920, against the known and unknown heirs of Ann E. McKinney, deceased, and others, defendants in error, hereinafter referred to as defendants.
