On the fourth day of the March term, 1874, of the board of commissioners of Allen county, the appellees petitioned, for the location and opening of a highway. Three viewers were appointed and directed to report at the June term. On the fifth day of the June term, the viewers reported against the opening of the road, and the commissioners entered an order approving the report, and declaring that the proposed highway should not be opened.
